Illinois courts recognize diminished value as recoverable property damage when you're pursuing a claim against the at-fault driver's insurer: under Trailmobile Div. of Pullman, Inc. v. Higgs (Ill. App. Ct. 1973), if your repaired vehicle is worth less than it was before the accident, you're entitled to that difference in market value on top of repair costs. (Claims against your own insurer under standard "repair or replace" policy language are a different story — Illinois courts have held insurers generally don't owe diminished value there.) Illinois's five-year statute of limitations for property damage claims (735 ILCS 5/13-205) gives you time to build your case, but the sooner you document your loss, the stronger your claim.
