Georgia is one of the few states where insurers must pay diminished value even on a first-party claim against your own insurance company — a right established by the Georgia Supreme Court in State Farm Mutual Automobile Insurance Co. v. Mabry, 274 Ga. 498, 556 S.E.2d 114 (2001), which held that a repaired vehicle's lost resale value must be compensated even when the repair fully restores its appearance and function. Georgia's general limitations period for these property-damage claims is four years under OCGA § 9-3-32. If your vehicle was repaired after an accident that wasn't your fault — or even under your own policy — you may be owed the difference between its pre-accident and post-repair market value.

If your insurer declared your vehicle a total loss, Georgia regulation controls how that payout must be calculated — Ga. Comp. R. & Regs. r. 120-2-52-.06 requires settlement based on the actual cost of a comparable vehicle plus applicable taxes and fees, though Georgia sets no fixed percentage threshold for when a vehicle must be totaled in the first place.
