DC courts have recognized that a repaired vehicle can still be worth less than before the accident: in American Service Center Associates v. Helton, the DC Court of Appeals held that owners may recover both repair costs and the residual diminution in value, provided the total doesn't exceed the vehicle's gross loss in value. You have three years from the date of the accident to bring a claim under D.C. Code § 12-301, and claims up to $10,000 can go through DC Superior Court's Small Claims Branch under D.C. Code § 11-1321.
