Arkansas Vehicle Valuation

Choose Your Arkansas Vehicle Valuation Path

Not every Arkansas vehicle valuation dispute is the same. If your car was damaged, repaired, and returned to you, but it's now worth less simply because it has an accident on its history — that's a diminished value claim, typically pursued against the at-fault driver's insurer. If your insurer instead declared your vehicle a total loss and you believe their payout undervalues it, that's a total loss appraisal dispute, governed by Arkansas's salvage-title threshold and Insurance Department settlement rules. Below, choose the path that matches your situation.

01

Arkansas courts recognize diminished value as recoverable property damage: in MFA Ins. Co. v. Citizens Nat. Bank of Hope, 545 S.W.2d 70 (Ark. 1977), the Arkansas Supreme Court held that when repairs don't fully restore a vehicle's prior value, the proper measure of damages is the difference in the vehicle's value before and after the loss. Arkansas's general three-year statute of limitations for property damage claims (Ark. Code Ann. § 16-56-105) applies to these claims. If your vehicle was repaired after an accident that wasn't your fault, you may be entitled to recover the value it lost simply from having an accident on record.

02

Arkansas ties total loss and salvage titling to a specific legal threshold — 70% of a vehicle's average retail value under Ark. Code Ann. § 27-14-2301(6)(B) — and requires insurers to follow a defined settlement process under Arkansas Insurance Department Rule 43. But Arkansas law does not guarantee you a formal appraisal right if you think your insurer's total loss number is too low. If your car was totaled and the payout feels short, an independent appraisal gives you the documented local market evidence needed to negotiate a fairer settlement.
